Terms of Use

1. Agreeing to these Terms

These Terms of Use are an agreement between you and Jerry St. Sauver (“we”, “us”), the developer of Dad Joke Battle (the “app”). By using the app, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app.

2. Who can use the app

You must be at least 13 years old to use Dad Joke Battle. If you're under the age of majority where you live, you need a parent or guardian's permission, and they agree to these Terms on your behalf.

3. Your account

The app creates a guest account for you automatically. You can link it to Sign in with Apple to keep your data across devices. You're responsible for what happens on your account. Don't create accounts to get around a ban or to manipulate votes.

4. Playing the game

Each battle shows two jokes, and you choose the funnier one. Votes count toward the leaderboard. Most jokes come from icanhazdadjoke.com, and some are submitted by players. We may change, pause or stop any part of the app at any time, and we don't guarantee it will always be available or free of errors.

Don't interfere with the app or its servers. That includes using scripts, bots or multiple accounts to cast votes, trying to get into other players' accounts, or reverse engineering the app except where the law allows it.

5. Jokes you submit

• You keep ownership. The jokes you submit are yours.
• You give us permission to use them. When you submit a joke, you grant us a worldwide, non-exclusive, royalty-free license to store, display, reproduce and distribute it in the app and on this website, and to use it to promote Dad Joke Battle. You can end this license by deleting the joke or your account. Copies already shared by other players aren't affected.
• You have the right to share it. Only submit jokes you wrote or are allowed to share, and that follow the community rules below.
• Jokes are checked before they're shown. Submissions are screened automatically and may be reviewed by a person. We can decline, hide or remove any joke at any time, for any reason.

6. Community rules

Dad jokes are meant to be groan-worthy, not hurtful. There is zero tolerance for objectionable content or abusive users. Don't submit jokes that:

• are hateful, or demean people based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age or any other protected trait
• harass, bully, threaten or intimidate anyone
• are sexual or sexually suggestive, or contain graphic violence
• promote illegal activity, self-harm, drugs or weapons
• include anyone's personal information, such as names, addresses, phone numbers or account details
• impersonate someone, or copy someone else's work without permission
• are spam, advertising, links, or not jokes at all

7. Reporting, blocking and moderation

• Report: long-press any community joke and choose “Report joke…”. Jokes that several players report are hidden automatically while we review them.
• Block: long-press a community joke and choose “Block this author”. You won't see that author's jokes in battles or on the leaderboard. You can unblock them in Profile → Settings → Blocked Authors.
• Our response: we review reports and act on objectionable content within 24 hours. We remove content that breaks these rules and ban players who post it.

8. Suspension and deletion

We may remove your jokes, or suspend or delete your account, if you break these Terms, abuse other players or the app, or if the law requires it. You can stop using the app at any time, and you can delete your account from Profile → Settings → Delete Account. Sections 5, 9 and 11 to 15 continue to apply after your account is deleted.

9. Our content

The app, this website, and their design, artwork and code belong to us or our licensors. These Terms don't give you any rights to them beyond using the app as intended. Jokes from icanhazdadjoke.com belong to their respective owners.

10. Other services

The app relies on services run by others, including Apple, Google Firebase and icanhazdadjoke.com. Their own terms apply to your use of them, and we aren't responsible for them.

11. Disclaimers

The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. Jokes are for entertainment. Community jokes are written by players, not by us, and don't reflect our views.

12. Limitation of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, arising from your use of the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us for the app in the past 12 months or US $10. Some places don't allow these limits, so they may not apply to you.

13. App Store terms

If you got the app from Apple's App Store, these terms also apply:

• These Terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
• Your license to use the app is also subject to Apple's Licensed Application End User License Agreement and the App Store's usage rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app.
• Apple isn't responsible for any claims by you or anyone else relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
• If anyone claims the app infringes their intellectual property, we, not Apple, are responsible for investigating, defending and settling that claim.
• You confirm that you're not located in a country subject to a U.S. government embargo or designated as “terrorist supporting”, and that you're not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes to these Terms

We may update these Terms. If we do, we'll change the date at the top, and for significant changes we'll let you know in the app or on this site before they take effect. If you keep using the app after a change takes effect, you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict of law rules. If you live outside the United States, you also keep any protections the law where you live gives you.
